Section 26
Special Arrangements for Hearing Petitions for Detainee Directing
(1) If the court remains closed for a period of three days or more, a judge shall be appointed as follows to take and hear the application for the detention during the period of such leave:
(a) Judges of the Supreme Court appointed by the Chief Justice in the case of Kathmandu Valley,
(b) in the case of a district where there is a High Court and a District Court, the Judge of the High Court appointed by the Chief Justice of the High Court. (c) Other than clauses (a) and (b), the judge of the district court concerned and the district judge designated by the district judge who will act as the main judge if there is more than one district judge in such district court.
(2) Notwithstanding anything written in this Act or any other prevailing law, the judge appointed under sub-section (1) may issue an appropriate order on the petition filed in the relevant court during the period of leave and the relevant officer shall execute such order regardless of the period of leave.
(3) In accordance with this section, the place for filing and hearing the application shall be as determined by the judge designated under sub-section (1).
